Lease of the 85 Acre Tract to the College
THIS INDENTURE, Made this twentieth day of November A.D. 1911 between J. A. Burden, J. R. Scott, C. A. Burrows, Luther Warren, Mrs. E. G. White, A. W. Shryock, Josephine Gotzian and W. A. Ruble, the parties of the first part, and College of Medical Evangelists, a corporation of Loma Linda, County of San Bernardino, and State of California, the party of the second of part. LLM 588.3
WITNESSETH: That the said parties of the first part do by these presents lease and demise unto the said party of the second part the following described real property situated in the County of San Bernardino, and State of California, to wit: LLM 588.4
A portion of Lots 11 and 12, Block 75 of the 80 acre survey Rancho San Bernardino, described as beginning at the northwest corner of said Lot 11, running thence east along center line of Colton Avenue 2650.7 feet to the northeast corner of said Lot 12, thence southerly along the center line of Pepper Drive, 1360 feet, thence westerly 2653 feet, thence northerly 1406 feet to place of beginning, containing 85.56 acres more or less; also beginning at the northwest corner of the SPRR Depot reservation at Loma Linda, thence southerly 200 feet, thence westerly 261 feet, thence northerly 203 feet, thence easterly 295 feet to the place of beginning, said last described tract being known as Block 12 of the Map of Mound City as recorded in Book 6 of Maps at Page 28, containing 1 1/3 acres; also one-fourth interest in the waste waters of Mill Creek formerly owned by J. H. Kelly, with the appurtenances for the term of one year from the 26th day of April one thousand nine hundred and eleven at the annual rent or sum of an amount equal to the annual tax, interest at the rate of seven percent on the purchase price, and necessary improvements payable in gold (974) coin of the United States of America, as the same is needed in advance, on the first days when the taxes shall become due, and in no event to permit the same to become delinquent. All payments being made so as to satisfy the obligations mentioned as they become due LLM 588.5
AND IT IS FURTHER AGREED, that if any rent shall be due and unpaid, or if default shall be made in any of the covenants herein contained, that it shall be lawful for the said parties of the first part to reenter the said premises, and remove all persons therefrom. And the said party of the second part does hereby covenant, promises and agrees to pay the said parties of the first part the said rent in the manner hereinbefore specified, and not to let or underlet the whole or any part of the said premises without the written consent of the said parties of the first part. And that, at the expiration of the said term, the said party of the second part will quit and surrender the said premises in as good state and condition as reasonable use and wear thereof will permit (damage by the elements excepted).
